These Terms of Service (“Terms”) govern your access to and use of SiteTrak (the “Service”), operated by SiteTrak (a DBA based in California, USA) (“SiteTrak,” “we,” “us,” or “our”). By creating an account or otherwise using the Service, you agree to be bound by these Terms.
1. The Service
SiteTrak provides website monitoring, performance analysis, and diagnostic tools, including uptime monitoring, real user monitoring (RUM), Core Web Vitals tracking, SEO audits, and security scans. Specific features available depend on your subscription plan.
2. Accounts
You must register for an account to use most features. You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. You must be at least 18 years old to use the Service. You agree to provide accurate, current, and complete information at registration and to keep it up to date.
3. Acceptable Use
You agree not to:
- Use the Service to monitor websites you do not own or do not have permission to monitor.
- Use the Service in any way that violates applicable law.
- Attempt to interfere with, compromise, or disrupt the Service or its infrastructure.
- Use the Service to transmit malware, conduct denial-of-service attacks, or scrape at abusive frequencies.
- Resell, redistribute, or white-label the Service without a written agreement with us.
We reserve the right to suspend or terminate accounts that violate these rules.
4. Subscriptions, Billing & Cancellation
Paid plans are billed in advance on a monthly or annual basis through Stripe. Subscriptions renew automatically until canceled. You may cancel at any time from your billing dashboard; cancellation takes effect at the end of the current billing period.
Refunds are governed by our Refund Policy.
We may change subscription prices with at least 30 days’ notice via email. Continued use after a price change constitutes acceptance of the new pricing.
5. Customer Data
You retain all rights to data you submit to the Service, including domain configurations, monitor settings, and data collected from sites you operate. We process this data only to provide and improve the Service, as described in our Privacy Policy.
You grant us a limited license to host, store, transmit, and process your data for the purpose of operating the Service. You may export or delete your data at any time.
6. Service Availability
We aim for high availability but do not guarantee uninterrupted access. The Service is provided “as is” and “as available.” We may perform maintenance, updates, or modifications that temporarily limit access.
7. Intellectual Property
The Service, including its source code, design, and branding, is owned by SiteTrak and is protected by copyright and other intellectual property laws. We grant you a limited, non-exclusive, non-transferable license to use the Service as permitted by these Terms.
8. Termination
You may close your account at any time. We may suspend or terminate your access to the Service if you breach these Terms, fail to pay fees when due, or use the Service in a manner that creates risk or legal exposure for us.
Upon termination, your data will be retained for 30 days to allow recovery, after which it will be permanently deleted unless we are required by law to retain it longer.
9. Disclaimer of Warranties
THE SERVICE IS PROVIDED “AS IS” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. We do not warrant that monitoring data, alerts, or any output of the Service will be error-free, complete, or timely.
10. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, SITETRAK’S TOTAL LIABILITY FOR ANY CLAIM ARISING OUT OF OR RELATED TO THE SERVICE IS LIMITED TO THE AMOUNT YOU PAID US IN THE TWELVE MONTHS PRECEDING THE EVENT GIVING RISE TO THE CLAIM. IN NO EVENT SHALL WE BE LIABLE FOR ANY INDIRECT, INCIDENTAL, CONSEQUENTIAL, SPECIAL, OR PUNITIVE DAMAGES, INCLUDING LOST PROFITS OR DATA.
11. Indemnification
You agree to indemnify and hold SiteTrak harmless from any claim arising out of your use of the Service in violation of these Terms or applicable law, or out of data you submit that infringes the rights of a third party.
12. Governing Law
These Terms are governed by the laws of the State of California, USA, without regard to its conflict-of-laws principles. Any dispute arising under these Terms shall be brought exclusively in the state or federal courts located in California, and you consent to personal jurisdiction in those courts.
13. Changes to These Terms
We may update these Terms from time to time. Material changes will be announced via email or prominently on the Service at least 30 days before they take effect. Continued use after changes take effect constitutes acceptance.
